1. Acceptance of Terms

By accessing or using FastStat.io (the "Service"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Haist Technologies LLC d/b/a FastStat ("FastStat", "we", "us", or "our").

Your continued use of the Service after any modifications to these Terms constitutes your acceptance of the updated Terms.

2. Service Description

FastStat provides sports data analytics, statistical analysis tools, player statistics, game insights, and parlay prediction features for informational and entertainment purposes only.

2.1 What FastStat Provides

• Sports player statistics and performance data
• Historical data analysis and trend identification
• Statistical projections and predictive analytics
• Parlay builder and combination tools

2.2 What FastStat Does NOT Provide

FastStat does NOT:

• Accept wagers, bets, or real-money gambling
• Operate as a sportsbook, casino, or gambling platform
• Facilitate transactions between users and gambling operators
• Guarantee on outcomes, predictions, or winnings
• Provide professional gambling advice or recommendations
• Encourage, promote, or endorse gambling activities

2.3 Important Disclaimer

ALL STATISTICS, PREDICTIONS, AND ANALYTICS PROVIDED BY FASTSTAT ARE FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY.

FastStat does not guarantee the accuracy, completeness, or timeliness of any data or predictions. Past performance is not indicative of future results.

3. Eligibility & User Responsibilities

3.1 Age Requirement

You must be at least 18 years of age to create an account and use FastStat.

By creating an account, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into binding contracts
• You are not prohibited from using the Service under applicable laws
• All information you provide is accurate, complete, and truthful

We do not verify age independently. You affirm your age by checking the age verification box during account creation. Providing false information is a violation of these Terms and may result in immediate account termination.

3.2 Sports Betting & Gambling Laws

FastStat provides sports analytics, statistical data, and informational content only. We do not facilitate, encourage, or engage in gambling activities.

If you choose to use FastStat's information to inform sports betting decisions, you acknowledge and agree that:

• You are solely responsible for complying with all applicable gambling laws and regulations in your jurisdiction
• Sports betting may be illegal or restricted in your location
• You will not hold FastStat liable for any legal consequences of your gambling activities
• You will not use FastStat in any jurisdiction where sports betting is prohibited

3.3 Prohibited Locations

FastStat is available globally, but users are prohibited from using the Service for illegal sports betting or gambling in jurisdictions where such activities are prohibited.

You are responsible for knowing and complying with your local laws.

4. Account Registration & Security

4.1 Account Creation

When you create an account:

• You must provide accurate, current, and complete information
• You must use a valid email address that you control
• You may not impersonate another person or entity
• You may not create multiple accounts for the same person
• You may not use automated tools to create accounts

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• Choosing a strong, unique password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breach

FastStat is NOT responsible for unauthorized access resulting from your failure to secure your account.

4.3 Account Sharing

You may not share your account credentials with anyone. Each account is for individual use only. Account sharing may result in immediate termination.

5. Acceptable Use Policy

You agree to use FastStat only for lawful purposes and in accordance with these Terms.

5.1 Prohibited Activities

You agree NOT to:

Data Scraping & Extraction:

• Copy, scrape, crawl, or extract data from FastStat for use outside the Service
• Use automated scripts, bots, crawlers, or screen scrapers to access the Service
• Circumvent rate limits, access restrictions, or technical safeguards
• Redistribute, resell, or commercialize data obtained from FastStat

Reverse Engineering:

• Reverse engineer, decompile, or disassemble any software or technology used by FastStat
• Attempt to discover the source code or algorithms used by FastStat
• Create derivative works based on FastStat's technology

Security & Abuse:

• Attempt to gain unauthorized access to accounts, systems, or networks
• Interfere with or disrupt the Service or servers
• Introduce viruses, malware, or harmful code
• Conduct denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks

Illegal Gambling & Fraud:

• Use the Service to facilitate illegal gambling operations
• Use the Service to commit fraud or financial crimes
• Use stolen payment methods or credentials

Misuse of Account:

• Share your account credentials with others
• Create multiple accounts to evade restrictions or bans
• Impersonate another user, person, or entity

Violations of Law:

• Violate any applicable local, state, national, or international law
• Use the Service for money laundering or terrorist financing

5.2 Consequences of Violations

Violations of this Acceptable Use Policy may result in:

• Immediate account suspension or termination
• Removal of access to the Service
• Legal action and cooperation with law enforcement
• No refunds for unused subscription periods

6. Subscriptions & Payments

6.1 Subscription Plans

FastStat offers both free and paid subscription plans. Paid plans provide access to premium features, enhanced analytics, and additional data.

6.2 Billing & Payment

• Subscription fees are charged in advance on a recurring basis (monthly or annually)
• All payments are processed securely through Stripe, Inc.
• You authorize us to charge your payment method for all subscription fees
• All fees are non-refundable except as required by law

Data We Receive from Stripe:

When you subscribe or make payments, we receive and store:

• Stripe Customer ID (unique identifier linking your account to Stripe)
• Subscription details (status, billing period, pricing, renewal dates, cancellation information)
• Payment transaction records (invoice IDs, amounts, payment status, timestamps)
• Webhook event data containing complete event payloads, which may include:
  • Email addresses associated with Stripe customer accounts
  • Billing postal codes from payment methods
  • Payment method details (last 4 digits, card brand, expiration)
  • Custom metadata attached to subscriptions or customer records
  • Transaction descriptions and failure messages
• Invoice and receipt URLs for your records

This data is necessary to manage your subscription, process payments, synchronize subscription status, provide customer support, troubleshoot billing issues, maintain billing history, and comply with financial record-keeping requirements. Webhook event logs are retained for 90 days then permanently deleted. Payment and subscription records are retained for 7 years as required by law. See our Privacy Policy for more information on how we use and protect this data.

Analytics Data:

We use analytics services to improve our Service and understand user behavior:

• Vercel Analytics: Anonymized traffic, page views, and performance metrics
• Google Analytics 4: Usage patterns, conversion tracking, feature engagement, and user interactions (with your consent)

You can opt out of Google Analytics tracking through our Cookie Settings page or by enabling "Do Not Track" in your browser. We honor Do Not Track signals and will not load Google Analytics if DNT is enabled. For more information, see our Privacy Policy.

6.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

To cancel: Visit your account settings or contact support@faststat.io at least 24 hours before the next renewal date.

6.4 Price Changes

We reserve the right to change subscription prices at any time. If we increase your subscription price:

• You will be notified at least 30 days in advance
• The new price will apply to your next billing cycle
• You may cancel before the new price takes effect to avoid the increase

6.5 Refund Policy

All subscription fees are non-refundable except:

• If required by applicable law
• If we determine a refund is warranted at our sole discretion
• If a billing error occurred

No refunds for partial months or unused subscription periods.

6.6 Failed Payments

If your payment method fails:

• We will notify you and attempt to charge your payment method again
• Your access to premium features may be suspended until payment is successful
• If payment fails for 15 days, your subscription may be canceled

7. Intellectual Property Rights

7.1 Our Ownership

All content, features, software, technology, data, trademarks, logos, and materials available on FastStat are owned by or licensed to Haist Technologies LLC and are protected by United States and international intellectual property laws.

7.2 Your Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use FastStat for personal, non-commercial purposes
• View and interact with statistics and analytics within the Service

You may NOT:

• Copy, modify, distribute, sell, or lease any part of FastStat
• Use FastStat for commercial purposes without written permission
• Remove or obscure copyright notices, trademarks, or proprietary markings

7.3 Third-Party Intellectual Property

FastStat is not affiliated with, endorsed by, or sponsored by the NFL, any NFL team, or any other professional sports league or team.

Team names, logos, player names, and other trademarks are the property of their respective owners. FastStat uses these marks solely for identification and reference purposes in connection with providing sports statistics and analytics.

All sports data is obtained from publicly available sources and licensed third-party data providers.

7.4 User Content

If you submit feedback, suggestions, comments, or ideas ("User Content") to FastStat:

• You grant us a worldwide, royalty-free, perpetual, irrevocable license to use, modify, reproduce, and incorporate your User Content
• You represent that your User Content does not violate the rights of any third party
• We are not obligated to use or respond to your User Content

8. Disclaimers & No Warranties

8.1 Informational & Entertainment Purposes Only

FASTSTAT PROVIDES STATISTICAL ANALYSIS, PREDICTIONS, AND DATA FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY.

FastStat is NOT:

• Professional gambling advice or financial advice
• A guarantee of outcomes, predictions, or winnings
• A recommendation to place bets or wagers
• Investment advice or a substitute for professional counsel

8.2 No Guarantee of Accuracy

We strive to provide accurate and up-to-date information, but:

• We do not guarantee the accuracy, completeness, or timeliness of any data
• Data may contain errors, omissions, or delays
• Statistics and predictions are estimates and may not reflect actual outcomes
• Past performance is not indicative of future results

8.3 "AS IS" and "AS AVAILABLE"

FASTSTAT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Freedom from viruses or harmful components

8.4 Service Availability

We do not guarantee that:

• FastStat will be available at all times
• The Service will be free from interruptions, delays, or errors
• Defects will be corrected
• Data will be backed up or stored indefinitely

8.5 Third-Party Services

FastStat may integrate with or link to third-party services (e.g., payment processors, data providers). We are not responsible for:

• The availability, accuracy, or reliability of third-party services
• The privacy practices or content of third-party sites
• Any damages resulting from your use of third-party services

9. Limitation of Liability

9.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Our total liability for any claims arising out of or related to these Terms or your use of FastStat will NOT exceed the greater of:

• The amount you paid to FastStat in the 12 months immediately preceding the claim, OR
• $100.00 (One Hundred United States Dollars)

9.2 Exclusion of Consequential Damages

WE WILL NOT BE LIABLE FOR:

• Indirect, incidental, special, exemplary, or consequential damages
• Lost profits, revenue, or business opportunities
• Loss of data or information
• Gambling or betting losses of any kind
• Inaccurate predictions, statistics, or data
• Service interruptions, downtime, or technical failures
• Costs of procuring substitute services
• Damages resulting from your reliance on FastStat's data

This limitation applies even if we have been advised of the possibility of such damages.

9.3 Basis of the Bargain

You acknowledge that the fees charged by FastStat reflect this allocation of risk and that FastStat would not provide the Service without these limitations.

9.4 State-Specific Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Haist Technologies LLC, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of FastStat
• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of any third-party rights (including intellectual property rights)
• Any gambling or betting losses you incur
• Any User Content you submit
• Your breach of any representation or warranty in these Terms

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, at your expense.

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Contacting support@faststat.io

Upon termination:

• Your access to the Service will be immediately revoked
• Your subscription will not renew at the end of the current billing period
• No refunds will be provided for unused subscription time
• Your data will be deleted in accordance with our Privacy Policy

11.2 Termination by Us

We may suspend or terminate your account immediately, without notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Violation of our Acceptable Use Policy
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Abusive behavior toward our staff or other users
• At our sole discretion, for any reason or no reason

11.3 Effect of Termination

Upon termination:

• All licenses and rights granted to you under these Terms will immediately cease
• You must cease all use of the Service
• Subscription and payment records will be retained for 7 years for tax, accounting, and legal compliance purposes
• Webhook event logs containing billing data will be retained for 90 days, then permanently deleted
• Sections of these Terms that by their nature should survive (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply

12. Dispute Resolution & Arbitration

12.1 Informal Resolution

Before filing a claim, you agree to contact us at legal@faststat.io and attempt to resolve the dispute informally.

We will work in good faith to resolve disputes amicably.

12.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of FastStat will be resolved by binding arbitration, rather than in court, except that:

• You may file an individual action in small claims court if the claim qualifies
• Either party may seek injunctive or equitable relief in court to prevent infringement of intellectual property rights

Arbitration Rules:

• Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
• The arbitration will take place in Hamilton County, Indiana, or remotely via video conference
• The arbitrator's decision will be final and binding
• Each party will bear its own arbitration costs, except as otherwise provided by AAA rules

12.3 Class Action Waiver

YOU AND FASTSTAT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

You waive any right to participate in a class action lawsuit or class-wide arbitration against FastStat.

12.4 Opt-Out of Arbitration

You may opt out of arbitration by sending written notice to legal@faststat.io within 30 days of account creation. If you opt out, all disputes will be resolved in the courts specified in Section 13.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, United States of America, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or related to these Terms (if arbitration is waived or inapplicable) must be brought exclusively in the state or federal courts located in Hamilton County, Indiana.

You consent to the personal jurisdiction of such courts and waive any objection to venue.

14. Changes to These Terms

We reserve the right to modify or update these Terms at any time, at our sole discretion.

14.1 Notice of Changes

Material Changes:

• We will notify you via email to the address on your account
• We will display a prominent notice on the FastStat website or app
• Changes will take effect 30 days after notice is provided

Non-Material Changes:

• We will update the "Last Updated" date at the top of these Terms
• No separate notification is required
• Changes take effect immediately upon posting

14.2 Your Acceptance

Your continued use of FastStat after the effective date of changes constitutes your acceptance of the updated Terms.

If you do not agree to the changes:

• Stop using the Service
• Close your account before the changes take effect
• Contact us to exercise your rights under Section 11

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FastStat regarding the Service and supersede all prior agreements, understandings, and communications.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms at any time without notice.

15.5 No Third-Party Beneficiaries

These Terms do not and are not intended to confer any rights or remedies upon any person other than you and FastStat.

15.6 Force Majeure

We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
